They use it to distinguish between "Modifiable" (=purple with mods) and Modifiable Custom (=orange with mods). They don't mean any item that is called Custom can now be RE'ed. The only gear that that patch made RE'able was Battlemaster and War Hero crafted gear. All the other orange gear is all still not RE'able.
